Acceptable Use Policy

This Acceptable Use Policy (“AUP”) is a part of our Terms of Service between Convesio and Customers and applies to visitors and users of the Site; it describes certain restrictions related to your use of the Site and/or Services. We may update this AUP from time to time, in our sole discretion.

You are responsible for the actions and omissions of your Authorized Users and anyone to whom you provide access to your account or Services.

PROHIBITED ACTIVITIES

While using the Site, you are required to comply with all applicable statutes, orders, regulations, rules, and other laws. You may not use the Site for or any purpose other than that for which we make the Site available, for any fraudulent or unlawful purpose, and you may not take any action to interfere with the Site or any other party’s use of the Site. Additionally, we expect users of the Sites to respect the rights and dignity of others. For example, you may not do any of the following without our written consent:

  1. Post, upload, share, transmit, distribute, facilitate distribution of or otherwise make available to or through the Site or Services any content involving: trademark, copyright, trade secret, patent, or other intellectual property infringement; false advertising or fraud (including impersonating another user or person or use the username of another user); social engineering, phishing, or hacking (including attempting to trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords); illegal gambling; distribution of child pornography, child erotica, non-consensual sex acts (including in the support of or furtherance of sex trafficking), or bestiality; hate speech; harrassment, defamation, libel, or slander.
  2. Post or store to, or process through, the Site or Services any sensitive or otherwise regulated health or financial information about yourself or third-parties, such as social security, credit card or financial account numbers, health or medical information, or other information concerning personal matters. You acknowledge and agree that we are not responsible for any liabilities arising from your violation of this restriction;
  3. Use the Site or Services in violation of export controls, laws, regulations, or sanction policies of the United States or applicable jurisdiction;
  4. Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Site to you;
  5. Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us;
  6. Circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Site and/or the Content contained therein;
  7. Make improper use of our Services, support services, or submit false reports of abuse or misconduct;
  8. Engage in unauthorized framing of or linking any portion of, use of, or access to the Site or Services;
  9. Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the Services or Site or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Site;
  10. Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools;
  11. Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as “spyware” or “passive collection mechanisms” or “pcms”);
  12. Interfere with, disrupt, or create an undue burden on the Site or the networks or services connected to the Site;
  13. Attempt to bypass any measures of the Site designed to prevent or restrict access to the Site, or any portion of the Site; 
  14. Copy or adapt the Site’s software, including but not limited to Flash, PHP, HTML, JavaScript, or other code;
  15. Reverse engineer, decipher, decompile, disassemble, or otherwise attempt to derive the method of operation of any of the software comprising or in any way making up a part of the Site or Services;
  16. Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Site, or using or launching any unauthorized script or other software;
  17. Use a buying agent or purchasing agent to make purchases on the Site;
  18. Make any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending spam, unsolicited email, or creating user accounts by automated means or under false pretenses. Promoting or spam using the Services is prohibited and may result in immediate termination of your account.

    Liquidated Damages. You agree that we may immediately terminate any Account which we believe, in our sole and absolute discretion, is transmitting or is otherwise connected with any spam or other unsolicited bulk email. In addition, if actual damages cannot be reasonably calculated then you agree to pay us liquidated damages in the amount of $1.00 for each piece of spam or unsolicited bulk email transmitted from or otherwise connected with your Account.

  19. Use the Site or Services as part of any effort to compete with us or otherwise use the Site and/or Services content for any revenue-generating endeavor or commercial enterprise, or determine whether the Site or Services are within the scope of any patent;
  20. Sell or otherwise transfer your profile; and
  21. We prohibit the storing of website backups created by 3rd party services on our storage space. We provide daily backups and you are welcome to use 3rd party backup tools as long as the backups are sent to a storage location outside of our servers. 


Linking: 
You are granted a limited, non-exclusive right to create text hyperlinks to the Site or Services for informational purposes, provided such links do not portray us in a false, misleading, derogatory, or otherwise defamatory manner and provided that the linking Site does not contain any material that is unlawful, harmful, harassing, defamatory, threatening, intimidating, fraudulent, tortious, vulgar, obscene, hateful, pornographic, spam, discriminatory, violative of privacy or publicity rights, infringing of intellectual property or other proprietary rights, or otherwise objectionable in our sole discretion, including unauthorized or unsolicited advertising. 

Additionally, notwithstanding the foregoing, we grant to the operators of public search engines permission to use spiders to copy content from the Site or Services for the sole purpose of (and solely to the extent necessary for) creating publicly available, searchable indices of such content, but not caches or archives of such Content. We may revoke these permissions at any time. 

You must immediately notify Convesio of any breach of this Policy.
